Health law

Harkness Henry has enjoyed a long and successful relationship with several key participants in the health sector across the Waikato and New Zealand.

In particular, we acted for a health funding authority in its successful defence of large scale and complex litigation brought by a number of health providers dissatisfied with the development and implementation of a new pricing model. More recently, we have been involved in the review and negotiation of contracts for the conduct of clinical research and in providing comprehensive legal advice to one of New Zealand’s largest non-governmental health providers. On a smaller scale, we provide urgent legal advice and assistance to clients faced with patients’ rights issues and other treatment related matters.

We understand the risks and challenges faced by organisations operating in the health sector and are able to advise on:

  • General compliance with legislation affecting the health sector
  • Contracts in the health sector
  • Subcontracting health services
  • Risk management and assistance with coronial inquries
  • Care of Children Act issues in respect of vulnerable patients
  • Applications for the appointment of welfare guardians and property managers under the Protection of Personal and Property Rights Act
  • Leases of premises for the carrying out of health related services and activities
  • Advice to Professional Conduct Committees
